IR35 deferred

Due in part to Covid-19 but also that the Government had not foreseen the wholesale eradication of UK contractors with all work being moved offshore, the chief treasury secretary, Steve Barclay, announced yesterday that the rollout of the IR35 has been deferred for a year until April 2021.

Unfortunately its a stay of execution rather than a complete cancellation of IR35 but its a good start.

Some good news at last for those who work on a contract basis and for those who represent them.

Shaun.

Hi Shaun

Will the Companies that have already determined IR35 status be able to backtrack?  A lot of them will have already geared up to implement it.

Hi John,

complete mess isn't it!

Contractors are still being let go because the wheel is already turning (even though the hamster is dead).

If someone is determined as inside IR35 under the tests which they really should not have had to be judged against now, then they would have a difficult job argueing that they are not, even though the implementation of the rules has been deferred.

Hi Shaun
Thanks for the update. I had clocked it but no time to post. Its been total chaos here what with the other doings with this pesky virus!.

Its great that it has been delayed, may be it will give HMRC time to sort out the complete mess, although I suspect their focus will still be elsewhere. Lots of professionals asking how it all works in practice. But as you say it has already decimated some industries workings with subbies - not least the banking industry.

Thoughts are my own/not to be regarded as official advice, which should be sought from a suitably qualified Accountant.

You should check out answers with reference to the legal position
