VAT - Guernsey ??


Hi All,

I am about to sign up a customer (Ltd - VAT Reg - CIS).   He is a one man band currently working as a sub contractor,  issuing a weekly vat invoice. 

However, the main contractor based in the  UK , to which his invoices are issued to, use  a payroll company based in Guernsey who  state that he is not allowed to issue a vat invoice to them.

He has sent me a reply to his query that he received from said payroll Company :-

 

 

`That is correct, because he supplying his services through our contract that has it?s office in Guernsey, he won?t charge VAT. But the VAT rules change from October anyway so he wouldn?t be able to charge VAT from 1st October to anybody he provides construction services to.`

Has anyone come across this before, is this correct,

Any pointers would be greatly appreciated

Hi Julie

That doesn't sound right at all.  If the contractor is based in the UK then the standard VAT rules apply. It's irrelevant where the payroll co is based, unless possibly the payroll co is a middleman between your client and the contractor.  Although in that case, I would expect the billing to be to the payroll co and not the contractor

That info about the October change is also wrong.  You still invoice + VAT, but the contractor pays it on your client's behalf.

Thanks John,

That sounds logical to me. Have asked my client to bring in all his paperwork to check on his invoicing address and any paperwork relating to the contract.

Hi Julie

I am far from being a VAT expert but my understanding is that if you are supplying services relating to land or property (which would include construction work) then the place of supply would always be where the land or property is located.

 Yup agree with Doug - construction = where property is located.

Apologies guys, have been tied up with vat deadlines !! Location of project is UK. Waiting for client to pop on with their paperwork later this week, will hopefully know more once spoken/seen their contract. Will keep you posted. Thank you again for input so far guys.
